Your User Content and Navelio’s use thereof as contemplated by this Agreement and the Service will not infringe any rights of any third party, including but not limited to any Intellectual Property Rights, privacy rights and rights of publicity.

Navelio may exercise the rights to your User Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise.

To the best of your knowledge, all your User Content and other information that you provide to us is truthful and accurate.

Navelio is not responsible for any public display or misuse of your User Content. You understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, objectionable, or inappropriate for children, and you agree that Navelio shall not be liable for any damages you allege to incur as a result of such User Content.

User Content License Grant

You retain all your ownership rights in your User Content. By posting any User Content on the Service, you expressly grant, and you represent and warrant that you have a right to grant, to Navelio a royalty-free, sub licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Service. Navelio reserves all rights not expressly granted herein in the Service and the Navelio Content (as defined below). Navelio may terminate this license at any time for any reason or no reason.

Liability

We accept no liability in relation to any contract you enter into or for any products or services you purchase. All agreements that arise through use of this Service are between you and the respective external contracting booking site. We do not act as an organiser or travel agency at any time. The terms and conditions of the respective organiser or travel agency apply exclusively, especially regarding the right to cancel and to withdraw. If you require any assistance with regards to reservations and payments, you should contact the booking site. Afflinks Ltd. remains uninvolved in such contractual arrangements. Our maximum liability to you if we are found to have been at fault in relation to the Service we provide (as opposed to any service provided by any third-party) is limited to the commission we have earned or are due to earn in relation to the booking in question. We are not liable either for the accuracy, quality, completeness, reliability or credibility of content provided to us by booking sites or suppliers. We do not guarantee the accuracy of information, in particular prices and availability. We accept no responsibility either if the information that we have published is the result of a technical or human error made by the booking site. We are not liable for technical malfunctions for which the cause is not within our sphere of responsibility or for damages caused by force majeure.
